The Halloweenie Beanie Giveaway ("Giveaway") begins at 12 p.m. C.T. on October 16, 2007 and ends at 3 p.m. C.T. October 31, 2007,("Giveaway Period"). The Giveaway is sponsored by Ty Inc., P.O. Box 5377, Oak Brook, IL 60522 ("Sponsor").

Eligibility: The Giveaway is open to natural persons who are registered members in good standing of Ty.com on or before 3 p.m. C.T., October 31, 2007, and who have internet access as of 12 p.m. C.T. on October 16, 2007. Employees, officers, and directors of Sponsor, its affiliates, subsidiaries, advertising, promotion, and fulfillment agencies ("Ty Personnel"), and those individuals who are immediate family members of Ty Personnel, or persons living in their same household as Ty Personnel, are not eligible to participate in the Giveaway. Void where prohibited. All federal, state, and local laws and regulations apply.

You may enter by clicking "Enter Me in the Drawing", either through the direct entry link or when prompted after voting for the 2007 Halloweenie Beanie! A new Giveaway will be held each day! You must enter each day in order to be eligible for each daily drawing. Only one entry per person per day will be allowed..

Prizes: All prize values are denominated in U.S. currency. No entries by facsimile, overnight courier, delivery service or electronic transmission (other than as described in the Official Rules).

Five prizes will be awarded each day. Only one prize per household. No alternative prize or substitution is permitted except by Sponsor in its sole discretion in the event of prize unavailability. All prizes will be awarded. Prizes are nontransferable. All federal, state and/or local taxes are the sole responsibility of the winner.

Selection of Winners: Potential winners will be determined by random daily drawing from all eligible entries at 3 p.m. C.T. each day from October 16, 2007 to October 31, 2007. Participants must enter separately each day in order to be eligible for that day's Giveaway. Odds of winning will be determined by the number of eligible entries received each day. Potential winners will be listed on the Ty.com web site (listed by user name and state only) before 5:00 p.m. C.T. the day of their selection. Within 72 hours of each day's drawing, potential winners will also receive an e-mail notification that will contain an affidavit of eligibility, waiver of liability and publicity release. Minor winners will also receive parental consent form. Potential winners will not be eligible to receive a prize without completion and return of a signed hard copy of the affidavit of eligibility, waiver of liability and publicity release (and, when appropriate, parental consent form), which must be returned within 15 days after Sponsor has e-mailed the notification packet, or any prize award will be void and will be awarded to an alternate winner, who will be chosen through a random drawing of remaining entries. Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to deliver the notification packet to winners. By accepting and/or using prize, winner agrees to the use of his/her name, voice, and/or likeness for the purpose of advertising, trade, or promotion without further compensation, unless prohibited by law. If a selected winner cannot be contacted, is ineligible, fails to claim a prize, or fails to timely return the completed and executed declaration and releases as required, the prize may be forfeited and awarded to an alternate winner.

If the potential winner is a minor, the prize will be awarded in the name of winner's parent or legal guardian, who is solely responsible for all applicable federal, state and local taxes. If potential winner is a minor, the potential winner must also provide signed parental or guardian consent, in a form provided by the Sponsor, within 15 days of receipt or any prize award will be void and will be awarded to an alternate winner, who will be chosen through a random draw of remaining entries. Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify winners or for any late, lost, misdirected, or unsuccessful efforts of a winner who is a minor to provide signed parental or guardian consent.

Conditions: By accepting a prize and becoming a qualified winner, each participant agrees to be bound by these Official Rules and the decisions of Sponsor, which shall be final. Sponsor, agents and representatives of Sponsor, its parent company, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors are not responsible for and shall not be liable for: (i) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (ii) failed, incomplete, garbled, or delayed computer transmissions; (iii) any condition caused by events beyond the control of the Sponsor that may cause the Giveaway to be disrupted or corrupted; (iv) any injuries, losses, or damages of any kind arising in connection with or as a result of any prize, or acceptance, possession, or use of any prize, or from participation in the Giveaway; or (v) any printing or typographical errors in any materials associated with the Giveaway. Sponsor reserves the right, in its sole discretion, to suspend or cancel the Giveaway at any time if a computer virus, bug, tampering, unauthorized intervention, or other technical problem of any sort corrupts the administration, security, or proper play of the Giveaway. Sponsor reserves the right to cancel the Giveaway or change any element thereof, with or without notice, at any time, due to printing errors, web site errors, transmission errors or other mistakes in the production of the Giveaway. Sponsor also reserves the right to disqualify, in its sole discretion, any person tampering with the entry process, the operation of the Website, or who is otherwise in violation of the rules.

By participating in the Giveaway, each participant agrees to release and hold Sponsor and the employees, officers, directors, shareholders, agents, representatives of Sponsor, its parent companies, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Giveaway or resulting from acceptance, possession, or use of any prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.
